Omake Terms of Service

These terms set out the conditions for using the Shopify app "Omake" ("the App") provided by Craftify Inc. ("we").

1. Scope and acceptance

  1. These terms apply between us and the operator of a Shopify store that installs and uses the App ("the Merchant").
  2. By installing the App, the Merchant agrees to these terms and to our Privacy Policy.

2. The App

The App adds gifts (free items and novelties) to carts that meet the conditions set by the Merchant and validates those conditions at checkout. On Shopify Plus stores, the App can also offer the gift inside checkout.

3. Fees

Fees are as shown on the App's Shopify pricing page and are billed through Shopify. Refunds follow Shopify's rules.

4. Data processing

  1. Roles. For shoppers' personal data processed by the App, the Merchant is the controller and we act as a processor on the Merchant's behalf, following the Merchant's settings in the App.
  2. Data and purposes. The data the App processes and why are described in our Privacy Policy. Customer tags of a logged-in shopper are checked on the spot to decide the gift conditions at checkout and are not stored.
  3. Purpose limitation. We process personal data only for those purposes, and we do not sell, rent, or otherwise provide it to third parties.
  4. Subprocessors. To provide the App we use services of Shopify Inc., Fly.io, Inc., and Supabase, Inc., and we require them to protect the data at a level equivalent to this section.
  5. Security. We encrypt data in transit and at rest, limit who can access the data, and take other reasonable security measures.
  6. Breach notification. If we become aware of a personal data breach, we will notify the Merchant without undue delay and take the necessary measures.
  7. Assistance. We will assist the Merchant, to the extent needed, in responding to shoppers' requests such as access or deletion.
  8. Deletion. When the App is uninstalled, we delete the data we hold about that store.

5. Prohibited use

The Merchant must not use the App in violation of law, infringe our or others' rights, access the App without authorization or place excessive load on it, or reverse engineer, copy, or redistribute the App.

6. Disclaimer and limitation of liability

  1. The App is provided as is. We do not guarantee that it fits the Merchant's particular purpose or that it always works with every theme or app combination.
  2. We are not liable for damage caused by changes to Shopify, outages, or other causes not attributable to us.
  3. If we are liable to the Merchant, our total liability is limited to the fees the Merchant paid for the App in the 12 months before the damage occurred, except in cases of our willful misconduct or gross negligence.

7. Changes to or ending the App

We may change the App or stop providing it. If we stop providing it, we will give reasonable advance notice.

8. Changes to these terms

We may revise these terms. We will announce changes on this page, and continued use of the App after the announcement means the Merchant accepts them.

9. Governing law and jurisdiction

These terms are governed by the laws of Japan. The Tokyo District Court has exclusive jurisdiction in the first instance over any dispute relating to these terms.
